In the Safe Streets Act of 1968, Congress determined "To assist state and local governments in reducing the incidence of crime."
This year I am proposing that the Congress provide the full $300 million that the Congress last year authorized to do just that.
I hope the Congress will put the money where the authorization is.
I believe this is an essential contribution to justice and to public order in the United States. I hope these grants can be made to the States and they can be used effectively to reduce the crime rate in this country.
But all of this is only a small part of the total effort that must be made--I think chiefly by the local governments throughout the Nation--if we expect to reduce the toll of crime that we all detest.
Frankly, as I leave the Office of the Presidency, one of my greatest disappointments is our failure to secure passage of a licensing and registration act for firearms. I think if we had passed that act, it would have reduced the incidence of crime. I believe that the Congress should adopt such a law, and I hope that it will at a not too distant date.

The Violent Crime Control and Law Enforcement Act (VCCLEA; also known as the Biden Crime Law) was an act of Congress dealing with crime and law enforcement that became law in 1994. It is the largest crime bill in the history of the US and will provide for 100,000 new police officers, $9.7 billion in funding for prisons and $6.1 billion in funding for prevention programs which were designed with significant input from experienced police officers. [1] Sponsored by U.S. Representative Jack Brooks of Texas, the bill was passed by Congress and signed into law by President Bill Clinton.
Following the 101 California Street shootings and other high-profile instances of violent crime, the act expanded federal law in several ways. One of the most noted sections was the Federal Assault Weapons Ban. Other parts of the act provided for a greatly expanded federal death penalty, new classes of individuals banned from possessing firearms, and a variety of new crimes defined in statutes relating to immigration law, hate crimes, sex crimes, and gang-related crime.

The Domestic Violence Offender Gun Ban (1996) was an amendment to the Omnibus Consolidated Appropriations Act of 1997 which was passed by the 104th US Congress in the Fall of 1996. Officially known as 'Gun Ban for Individuals Convicted of a Misdemeanor Crime of Domestic Violence' -- 18 U.S.C. § 922(g)(9)'[1], 'Public Law 104-208'[2] and is often referred to as the Lautenberg Amendment after its sponsor, Frank Lautenberg.
The Lautenberg Act conflicts with State Laws that are in effect that do not impose a statute under federal law, and or state laws preventing persons from owning a firearm, ammunition, or possessing of such items.
In Example: A person convicted of Domestic Violene in Texas is charged with and convicted of a Misdemeanor Charge Class A. A person convicted of Domestic Violence in very few other states Domestic Violence is charged as a felony.
In all states a violation of a protective order, as well as any other act of Domestic Violence while a protective order is in place is Considered a Felony and the Charges that were initially filed will automatically become a felony charge of Domestic Violence.
The Lautenberg Amendment and or Act does not specify to whether or not a Felony Conviction of Domestic Violence whether by plea, or by Deferred Adjudication or a Misdemeanor Charge of Domestic Violence should fall under the act.
The Lautenberg Amendment excludes all persons convicted of any type of Domestic Violence, or the Subject of a Magistrates Protective order from owning or possessing any type of Firearm, Ammunition, and or other types of weapons that involve a projectile device.
The nation's police forces are up in arms over a new federal gun control law that could strip thousands of them of their guns and jobs. Most police organizations have enthusiastically supported every gun control scheme President Clinton has put forward. Few Americans realized that such legislation almost always contained an exemption for the policemen themselves regarding their official duties. But poetic justice may finally have arrived. Unfortunately, its arrival also heralds the decimation of constitutional rights of a million or more other Americans.
Last September 28, as part of a massive appropriations bill, Congress passed the so-called Lautenberg Act, which greatly increases the number of Americans prohibited by federal law from owning firearms. For the first time, thanks to an amendment by Georgia's Rep. Bob Barr, law-enforcement officials are not exempt from the nation's gun control laws.
The Lautenberg Act prohibits anyone from owning a gun or possessing any ammunition who has ever been convicted of a misdemeanor involving the use or attempted use of physical force or the threatened use of a deadly weapon against a spouse, child, or intimate partner. (People with any felony conviction have been prohibited from owning guns since 1968.) Any person with such a misdemeanor on his record who is found in possession of a gun or even of a single bullet can face a $250,000 fine and 10 years in prison — longer than the average convicted murderer serves in this country.
Gerald Arenberg, executive director of the National Association of Chiefs of Police, observed that the act "has thrown the whole world into confusion for cops." Victor Kappeler, director of the Criminal Justice Graduate Program at Eastern Kentucky University, estimated that if accurate reporting of all such police domestic violence occurred, and if all such assaults were fully prosecuted, 10% of the nation's law-enforcement officials (70,000 individuals) could be found guilty and thus banned from possessing a firearm under the new law.

A BILL
To reauthorize the assault weapons ban, and for other purposes.
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the `Assault Weapons Ban and Law Enforcement Protection Act of 2007'.
SEC. 2. REINSTATEMENT FOR 10 YEARS OF REPEALED CRIMINAL PROVISIONS RELATING TO ASSAULT WEAPONS AND LARGE CAPACITY AMMUNITION FEEDING DEVICES.
(a) Reinstatement of Provisions Wholly Repealed- Paragraphs (30) and (31) of section 921(a), subsections (v) and (w) and Appendix A of section 922, and the last 2 sentences of section 923(i) of title 18, United States Code, as in effect just before the repeal made by section 110105(2) of the Violent Crime Control and Law Enforcement Act of 1994, are hereby enacted into law.
(b) Reinstatement of Provisions Partially Repealed- Section 924 of title 18, United States Code, is amended--
(1) in subsection (a)(1), by striking subparagraph (B) and inserting the following:
`(B) knowingly violates subsection (a)(4), (f), (k), (r), (v), or (w) of section 922;'; and
(2) in subsection (c)(1)(B), by striking clause (i) and inserting the following:
`(i) is a short-barreled rifle, short-barreled shotgun, or semiautomatic assault weapon, the person shall be sentenced to a term of imprisonment of not less than 10 years; or'.
SEC. 3. DEFINITIONS.
(a) In General- Section 921(a)(30) of title 18, United States Code, as added by section 2(a) of this Act, is amended to read as follows:
`(30) The term `semiautomatic assault weapon' means any of the following:
`(A) The following rifles or copies or duplicates thereof:
`(i) AK, AKM, AKS, AK-47, AK-74, ARM, MAK90, Misr, NHM 90, NHM 91, SA 85, SA 93, VEPR;
`(ii) AR-10;
`(iii) AR-15, Bushmaster XM15, Armalite M15, or Olympic Arms PCR;
`(iv) AR70;
`(v) Calico Liberty;
`(vi) Dragunov SVD Sniper Rifle or Dragunov SVU;
`(vii) Fabrique National FN/FAL, FN/LAR, or FNC;
`(viii) Hi-Point Carbine;
`(ix) HK-91, HK-93, HK-94, or HK-PSG-1;
`(x) Kel-Tec Sub Rifle;
`(xi) M1 Carbine;
`(xii) Saiga;
`(xiii) SAR-8, SAR-4800;
`(xiv) SKS with detachable magazine;
`(xv) SLG 95;
`(xvi) SLR 95 or 96;
`(xvii) Steyr AUG;
`(xviii) Sturm, Ruger Mini-14;
`(xix) Tavor;
`(xx) Thompson 1927, Thompson M1, or Thompson 1927 Commando; or
`(xxi) Uzi, Galil and Uzi Sporter, Galil Sporter, or Galil Sniper Rifle (Galatz).
`(B) The following pistols or copies or duplicates thereof:
`(i) Calico M-110;
`(ii) MAC-10, MAC-11, or MPA3;
`(iii) Olympic Arms OA;
`(iv) TEC-9, TEC-DC9, TEC-22 Scorpion, or AB-10; or
`(v) Uzi.
`(C) The following shotguns or copies or duplicates thereof:
`(i) Armscor 30 BG;
`(ii) SPAS 12 or LAW 12;
`(iii) Striker 12; or
`(iv) Streetsweeper.
`(D) A semiautomatic rifle that has an ability to accept a detachable magazine, and that has--
`(i) a folding or telescoping stock;
`(ii) a threaded barrel;
`(iii) a pistol grip;
`(iv) a forward grip; or
`(v) a barrel shroud.
`(E)(i) Except as provided in clause (ii), a semiautomatic rifle that has a fixed magazine with the capacity to accept more than 10 rounds.
`(ii) Clause (i) shall not apply to an attached tubular device designed to accept, and capable of operating only with, .22 caliber rimfire ammunition.
`(F) A semiautomatic pistol that has the ability to accept a detachable magazine, and has--
`(i) a second pistol grip;
`(ii) a threaded barrel;
`(iii) a barrel shroud; or
`(iv) the capacity to accept a detachable magazine at a location outside of the pistol grip.
`(G) A semiautomatic pistol with a fixed magazine that has the capacity to accept more than 10 rounds.
`(H) A semiautomatic shotgun that has--
`(i) a folding or telescoping stock;
`(ii) a pistol grip;
`(iii) the ability to accept a detachable magazine; or
`(iv) a fixed magazine capacity of more than 5 rounds.
`(I) A shotgun with a revolving cylinder.
`(J) A frame or receiver that is identical to, or based substantially on the frame or receiver of, a firearm described in any of subparagraphs (A) through (I) or (L).
`(K) A conversion kit.
`(L) A semiautomatic rifle or shotgun originally designed for military or law enforcement use, or a firearm based on the design of such a firearm, that is not particularly suitable for sporting purposes, as determined by the Attorney General. In making the determination, there shall be a rebuttable presumption that a firearm procured for use by the United States military or any Federal law enforcement agency is not particularly suitable for sporting purposes, and a firearm shall not be determined to be particularly suitable for sporting purposes solely because the firearm is suitable for use in a sporting event.'.
(b) Related Definitions- Section 921(a) of such title is amended by adding at the end the following:
`(36) Barrel Shroud- The term `barrel shroud' means a shroud that is attached to, or partially or completely encircles, the barrel of a firearm so that the shroud protects the user of the firearm from heat generated by the barrel, but does not include a slide that encloses the barrel, and does not include an extension of the stock along the bottom of the barrel which does not encircle or substantially encircle the barrel.
`(37) Conversion Kit- The term `conversion kit' means any part or combination of parts designed and intended for use in converting a firearm into a semiautomatic assault weapon, and any combination of parts from which a semiautomatic assault weapon can be assembled if the parts are in the possession or under the control of a person.
`(38) Detachable Magazine- The term `detachable magazine' means an ammunition feeding device that can readily be inserted into a firearm.
`(39) Fixed Magazine- The term `fixed magazine' means an ammunition feeding device contained in, or permanently attached to, a firearm.
`(40) Folding or Telescoping Stock- The term `folding or telescoping stock' means a stock that folds, telescopes, or otherwise operates to reduce the length, size, or any other dimension, or otherwise enhances the concealability, of a firearm.
`(41) Forward Grip- The term `forward grip' means a grip located forward of the trigger that functions as a pistol grip.
`(42) Pistol Grip- The term `pistol grip' means a grip, a thumbhole stock, or any other characteristic that can function as a grip.
`(43) Threaded Barrel- The term `threaded barrel' means a feature or characteristic that is designed in such a manner to allow for the attachment of a firearm as defined in section 5845(a) of the National Firearms Act (26 U.S.C. 5845(a)).'.
SEC. 4. GRANDFATHER PROVISION.
Section 922(v)(2) of title 18, United States Code, as added by section 2(a) of this Act, is amended--
(1) by inserting `(A)' after `(2)'; and
(2) by adding after and below the end the following:
`(B) Paragraph (1) shall not apply to any firearm the possession or transfer of which would (but for this subparagraph) be unlawful by reason of this subsection, and which is otherwise lawfully possessed on the date of the enactment of this subparagraph.'.
SEC. 5. REPEAL OF CERTAIN EXEMPTIONS.
Section 922(v)(3) of title 18, United States Code, as added by section 2(a) of this Act, is amended by striking `(3)' and all that follows through the 1st sentence and inserting the following:
`(3) Paragraph (1) shall not apply to any firearm that--
`(A) is manually operated by bolt, pump, level, or slide action;
`(B) has been rendered permanently inoperable; or
`(C) is an antique firearm.'.
SEC. 6. REQUIRING BACKGROUND CHECKS FOR THE TRANSFER OF LAWFULLY POSSESSED SEMIAUTOMATIC ASSAULT WEAPONS.
Section 922(v) of title 18, United States Code, as added by section 2(a) of this Act, is amended by adding at the end the following:
`(5) It shall be unlawful for any person to transfer a semiautomatic assault weapon to which paragraph (1) does not apply, except through--
`(A) a licensed dealer, and for purposes of subsection (t) in the case of such a transfer, the weapon shall be considered to be transferred from the business inventory of the licensed dealer and the dealer shall be considered to be the transferor; or
`(B) a State or local law enforcement agency if the transfer is made in accordance with the procedures provided for in subsection (t) of this section and section 923(g).
`(6) The Attorney General shall establish and maintain, in a timely manner, a record of the make, model, and date of manufacture of any semiautomatic assault weapon which the Attorney General is made aware has been used in relation to a crime under Federal or State law, and the nature and circumstances of the crime involved, including the outcome of relevant criminal investigations and proceedings. The Attorney General shall annually submit the record to the Congress and make the record available to the general public.'.
SEC. 7. STRENGTHENING THE BAN ON THE POSSESSION OR TRANSFER OF A LARGE CAPACITY AMMUNITION FEEDING DEVICE.
(a) Ban on Transfer of Semiautomatic Assault Weapon With Large Capacity Ammunition Feeding Device-
(1) IN GENERAL- Section 922 of title 18, United States Code, is amended by inserting after subsection (y) the following:
`(z) It shall be unlawful for any person to transfer any assault weapon with a large capacity ammunition feeding device.'.
(2) PENALTIES- Section 924(a) of such title is amended by adding at the end the following:

Senator Dianne Feinstein Mishandles "Assault Rifle" in Public
"There stood Dianne Feinstein, the anti-gun senator from California, posing for all the nation's media to capture on Kodachrome, holding an AK-47 with her finger firmly planted on the trigger." "Here's a woman so concerned about the supposed recklessness of gun manufacturers that she's calling for a ban on high-capacity ammunition magazines- the justification being little more than anecdotal evidence- who wouldn't know firearm safety if it bit her on the end of her upturned San Franciscan nose.
"Dianne Feinstein (D.-Calif.) Sponsor of the much-vaunted assault-weapon ban of 1994-2004. Despite the ban's having been found to have been misdirected and irrelevant to crime, Feinstein said she wished for a stronger law, one that would say, "Mr. and Mrs. America, turn [your firearms] all in." Feinstein carried a handgun for her own protection in California.

Kerry co-sponsored S. 1431 last year (The Assault Weapons Ban and Law Enforcement Protection Act of 2003) which would have banned a "semiautomatic shotgun that has a pistol grip.
Opponents of the bill successfully argued how nearly all guns have "pistol grips," including millions of Browning Auto-5 shotguns produced since 1903.
Photos show Kerry's hand resting on the "pistol grip," as loosely defined in the bill. [Section SEC. 2; (H) (ii) and (b)(42): "The term 'pistol grip' means a grip, a thumbhole stock, or any other characteristic that can function as a grip."]
Kerry was presented with the semiautomatic shotgun during a Labor Day stop in Racine, West Virginia.
"I thank you for the gift, but I can't take it to the debate with me," Kerry told a cheering crowd as he held up the device.
But Kerry's gun bill would have also banned any "gift" transaction!
[It is not clear if Kerry completed the required paperwork (Form 4473) before he claimed the gun.]

And when I was fighting to ban assault weapons in 1992 and 1993, Dean was appealing to the NRA for their endorsement, and he got it. Does Barack Obama Support a Gun Ban on Firearms ?
MILWAUKEE – Sen. Barack Obama this morning commented on Thursday's shootings at Northern Illinois University, as he also discussed his views on gun laws.
Before speaking to a rally here, Obama said the nation must do a "more effective job of enforcing our gun laws, strengthening our background check system, being able to trace guns that are used in violent crimes to unscrupulous gun dealers -- so that we can crack down on them -- closing gun show loopholes."
He specifically pointed to a California law as a possible model.
"There was a discussion today about a law that has just passed in California that allows micro-tracing of bullets that have been discharged in a crime so that they can immediately be traced," he said. "This is something that California has passed over the strong objections of the NRA…That's the kind of common sense gun law that gun owners as well as victims of gun violence can get behind."
Obama said he believes in the Second Amendment, but that there is plenty of room for added gun regulations. "There is an individual right to bear arms, but it's subject to commonsense regulation," he said.
Mentioning his home city, Obama said local entities should also have the ability to have their own more strict regulations.
"I think that local jurisdictions have the capacity to institute their own gun laws…The City of Chicago has gun laws, as does Washington, D.C.," he said. "I think the notion that somehow local jurisdictions can't initiate gun safety laws to deal with gang-bangers and random shootings on the street isn't born out by our Constitution."

Obama was being misleading when he denied that his handwriting had been on a document endorsing a state ban on the sale and possession of handguns in Illinois. Obama responded, "No, my writing wasn't on that particular questionnaire. As I said, I have never favored an all-out ban on handguns."
Actually, Obama's writing was on the 1996 document, which was filed when Obama was running for the Illinois state Senate. A Chicago nonprofit, Independent Voters of Illinois, had this question, and Obama took hard line:
35. Do you support state legislation to: a. ban the manufacture, sale and possession of handguns? Yes. b. ban assault weapons? Yes. c. mandatory waiting periods and background checks? Yes.
Obama's campaign said, "Sen. Obama didn't fill out these state Senate questionnaires--a staffer did--and there are several answers that didn't reflect his views then or now. He may have jotted some notes on the front page of the questionnaire, but some answers didn't reflect his views."

Concealed Carry OK for Retired Police Officers
Obama voted for a bill in the Illinois senate that allowed retired law enforcement officers to carry concealed weapons. If there was any issue on which Obama rarely deviated, it was gun control. He was the most strident candidate when it came to enforcin and expanding gun control laws. So this vote jumped out as inconsistent.
When I queried him about the vote, he said, "I didn't find that [vote] surprising. I am consistently on record and will continue to be on record as opposing concealed carry. This was a narrow exception in an exceptional circumstance where a retired police officer might find himself vulnerable as a consequence of the work he has previously done--and had been trained extensively in the proper use of firearms."
It wasn't until a few weeks later that another theory came forward about the uncharacteristic vote. Obama was battling with his GOP opponent to win the endorsement of the Fraternal Order of Police.

MILWAUKEE (AP) - Barack Obama said Friday that the country must do "whatever it takes" to eradicate gun violence following a campus shooting in his home state, but he believes in an individual's right to bear arms.
"I think there is an individual right to bear arms, but it's subject to commonsense regulation" like background checks, he said during a news conference.
He said he would support federal legislation based on a California law that would facilitate immediate tracing of bullets used in a crime. He said even though the California law was passed over the strong objection of the National Rifle Association, he thinks it's the type of law that gun owners and crime victims can get behind.
